  The Rottweiler involved in this case belongs to the local dog-keeping ban, but this provision has not been implemented at the time of the case, so it cannot be applied to determine the tort liability, but this does not mean that the breeder can escape the tort liability. In Article 1246 of the Civil Code, the breeder is required to take safety measures for raising animals. The safety measures required here should be considered in combination with the size of the dog, the possibility of injury and other aspects.

  In this case, it can be seen that compared with small dogs, large dogs are more difficult to control when injuries occur, and simple leashes are not enough to avoid the possibility of injuries, so breeders should have higher duty of care. Simple leashes can no longer prevent dogs from hurting people, and more comprehensive ways should be adopted, such as putting a condom on the dog’s mouth. Therefore, in this case, the leashing behavior of breeders cannot be considered as that they have taken safety measures and should bear tort liability.

  Case 2:

  At 19 o’clock on September 15, Wang was walking on the road and was hit by a big dog that suddenly jumped out. Immediately, Wang was sent to the hospital for treatment. The diagnosis was a fracture of the sacrum and multiple injuries.

  At the time of the incident, the local police station received 110 instructions and arrived at the scene to find out that the big dog was raised by He, and at the time of the incident, He’s dog was not on the leash. Wang sued He and demanded compensation for medical expenses, lost time and nutrition expenses totaling more than 30,000 yuan.

  The court held that Wang was injured by a pet dog raised by He, and He, as the keeper and manager of the pet dog, should bear tort liability according to law.

  After investigation, He has paid more than 10,000 yuan for the medical expenses advocated by Wang, and has no objection to the transportation expenses, follow-up treatment fees and spiritual comfort funds advocated by Wang.   3. How to deal with "the pet didn’t hurt people, but people were injured by pets"?

  Case 1:

  Recently, when riding a battery car through a section near Chen Mou’s home, Zhang was bitten by a dog from Chen Mou, which led to Zhang’s fall and hospitalization. Zhang then filed a lawsuit in court.

  The court held that because the animals themselves are dangerous, they may cause others to be frightened and have psychological fear and thus induce damage. Therefore, as long as the animals raised cause damage to others, they can constitute the responsibility of keeping animals for damage, and it is not necessarily a prerequisite for keeping animals to bite or scratch others.   In order to survive, we also tried every possible way. For example, we went to negotiate with many high-priced, medium and large-scale chain brands such as offline maternal and child stores, parenting education enterprises, catering, tourism and hotel industries. They are also the hardest hit areas of the epidemic, with no passenger flow and no revenue, and they are very anxious every day.

  Although it is difficult for us, what is better is that we have a platform and there are customers in the platform. The epidemic will eventually pass, and everyone will definitely go to offline service places for consumption.   For users, they get the same service at a more favorable price than usual; For businesses in offline service places, even if a part of the price system is sacrificed, with cash flow, it is possible to survive.

  During the recent period, I watched several movies, one of which was about Churchill’s "The Dark Hour", in which there was a line: No matter how horrible it is, we must strive for victory, no matter how long and difficult the road is, because we cannot survive without victory.

  Just like this line, no matter how difficult the road is, I will try my best to keep my company alive. We have to fight back to have a chance to survive.

  Lose 90 thousand a day and lay off 20% employees

  This year is the fifth year of my business. Up to now, the company brand has operated dozens of direct stores and signed nearly 100 contracts nationwide.

  Affected by the epidemic, most of our stores are closed, and only five direct stores have resumed business in an individual form, but they only provide take-away business. In fact, we are engaged in physical retail, and it is also the first time to try online sales. Orders are mainly from old members. Basically, a store has an average of about 3,000 orders a day.

  But this is just a drop in the bucket. The rent, manpower and the cost of various raw materials inventory are squeezing the small cash flow every day. We have calculated that there are basically losses of more than 90 thousand yuan a day, and there are more than 2.5 million yuan a month.

  Compared with those big companies, our small companies are even worse, because big companies will have some policy resources, and if they want money, they can get it through all channels. And we are the most uncomfortable, and we don’t expect much money from the outside world, so we still have to open up sources and reduce expenditure within the company.

  For us, if the epidemic can end before April, there may be nothing. However, if it is still spreading, we may cut off those unprofitable direct-operated stores. Otherwise, the headquarters office may be removed and all the unnecessary expenses that should be cut off will be cut off.

  To tell the truth, in small business groups, I think our losses should be less.   However, the sudden epidemic really caught me off guard and immediately shut down the store. Failure to open the door means that there is no cash flow, and there are a lot of hard costs such as rent and manpower every day. Now one of our stores loses about 10 thousand yuan a month, and four stores lose 40 thousand yuan. It’s uncomfortable!

  In order to reduce the loss, I shut down the telecom network fee, and the facade rented by the private landlord still has to pay rent; The state, the property side promised to reduce or exempt for two months.

  In terms of manpower, at first, I thought that the epidemic was short, and the wages at that time were normal. Later, it became more and more serious. I negotiated with my employees to let them wait for the door to open before coming to work. But out of a total of 16 people, only five people agreed to come, and two-thirds of them directly found jobs in their hometown factories.

  It is understandable that the company has difficulties, but it is not easy for employees. If they voluntarily apply for resignation, the risks will actually be completely passed on to employees, and the rights and interests of employees will not be guaranteed. I have been in the company for less than a year, and I only hope to pay compensation for half a month’s basic salary.

  That night, a dozen colleagues in my department and I didn’t make a choice. Some colleagues asked the person in charge of the personnel department what to do if the proposal was not agreed, and the reply was: I don’t know for the time being.

  I have been working in the Guangzhou headquarters of famous products for more than a year, and even though I was affected by the epidemic, my work did not slack off at all. Since February 10th, I have been working from home. Later, the company implemented a shift system, and everyone went back to the office for one to two days.

  Most of the company’s stores in China are franchised, and the store rent, store staff salaries and inventory are borne by franchisees. The company does not need to provide too much cash flow protection for this part of its main business. I hope to get a clearer explanation for the statement that the company has no cash flow.

  It is understandable that the company has encountered difficulties in special periods, and the performance of the store will be affected in February, but it is unreasonable that the salaries in January and March, which have not yet started, are all reduced. In addition, the company did not discuss with employees, did not mention replacement and compensation measures, and unilaterally proposed to leave without pay, which was also not in line with legal procedures.

  Originally, the wages of grass-roots employees were not high, and 30% of their wages were deducted from social security. How much is left? Leaving without pay is actually forcing you to leave in disguise. Our company has thousands of stores and tens of thousands of employees all over the country. I didn’t expect such a big company to be forced to retreat without compensation.

  There is also a clause in the proposal that if the workload is not saturated, it will be discounted if the salary is reduced. To put it bluntly, the company has the final say, so I don’t know if the employees on the job will be treated improperly again.

  Because I didn’t reply late on the evening of 21st, at about eleven o’clock on the morning of 22nd, HR called me and gave me two choices: 1. Leave my job by myself and work until the end of the month, and my salary will be paid in January and February; 2, leave without pay, pay 80% salary in January, 70% salary in February, and leave without pay in March. If you don’t reply before 2 pm, you will leave your job without pay by default.

However, just over a decade ago, Japanese whisky was just a neglected category, and Japanese manufacturers closed down one after another or sold themselves to foreign companies because of unsalable sales. No one expected that there would be today’s grand occasion.

So, is a bottle of Japanese whisky of several thousand dollars an IQ tax? How did it get fired to its current high position? What elements do you need for a wonderful marketing hype?

Let’s start with a conclusion. At this point, the price of Japanese whisky is far more than the drinking value, but it has financial attributes like assets such as houses, stocks and futures. Therefore, the analysis of its speculation path, just like the analysis of all financial assets that can be speculated, cannot be separated from four elements, namely:

A series of unique narratives that are generally accepted,

A handful of dealers with concentrated chips,

A large group of speculative hot money,

And an objective scarcity.

Here, you can pause and think about whether diamonds, Maotai, Bitcoin and school districts have all these four elements, or which one is missing.

The first is narrative, an infectious narrative can shape people’s cognition, and the unified cognition of a group of people is value. A group of people think that something is valuable, then it is valuable.

And if narrative is to be convincing and interesting, we should start from both rationality and sensibility.

Japanese whisky builds rational cognition by winning prizes. In 2001, a professional whisky magazine in Britain held a wine tasting contest. Among 293 whiskies sent by manufacturers, a whisky from Japan was rated as the first. In the same year, another Japanese whisky also won the gold medal in the internationally renowned liquor competition IWSC.

Therefore, it is necessary to rely on perceptual cognition, like multiple dreams in Inception, to implant an idea into people’s hearts with a large number of stories.

The most widely circulated story of Riwei is the magical wooden cask with water.

The barrel used for traditional whisky is oak, which is not available in Japan. Generally, it was imported from North America and Europe. The supply was interrupted during World War II, so we had to look for local substitutes. Finally, we found the water wood in Hokkaido, which seemed to be a last resort at that time, because it was not well sealed, the original wine was easy to leak and volatilize, and the aroma released in the first few years overshadowed the wine, which was very poor. So as soon as the war was over and the supply of oak resumed, the winery immediately put this inferior barrel aside.

Unexpectedly, 20 years later, Riwei became a friend of time. People accidentally opened the wooden barrels of water from the abandoned warehouse and found that the strong taste of the past had become only a faint sandalwood and incense, full of mysterious oriental flavor. This underwater wood has become a unique feature of Japanese whisky.

This counter-attack story was relished by whisky lovers, and the aroma of water chestnut was introduced to Mengxin as the characteristic of Riwei, but I didn’t know that I was just a spreading node of the story.

So these are the means by which Riwei establishes rational and perceptual cognition. The most direct and effective way of rational cognition is to look for authoritative endorsement, and well-known events belong to this link. Perceptual cognition needs to get to the heart of human nature, like the unsuspecting water bucket finally winning. This reversal is just like Maotai’s counterattack from loss to national wine, which is a story that most people like to hear.

In addition, the story will tell you that the water used by Riwei is the mountain spring of Japanese tea ceremony, the brewery is located in the unique terrain and climate of Japan, and the filtering material is bamboo instead of peat.

It is true that these factors will lead to objective differences in taste, but such subtle differences, ordinary people drink, "tasted, but it seems that they have not tasted", and drink after accepting the above emotional narrative, "it is worthy of the taste of sandalwood, temples, bamboo forests and clear springs!"

However, how did this series of infectious narratives form and how did they get their first spread? This is the second element, the banker.

When we say that there are bookmakers in a market, we mean that most of the chips are concentrated in the hands of a few people. Only by controlling most of the chips can the holder ensure that he will not make wedding clothes for others and have the incentive to invest in speculation.
